DENVER TOOL LIBRARY LENDING - LIABILITY WAIVER

This Agreement is effective upon the date signed and pertains to the Denver Tool Library’s Tool Lending Program and lessor Archie Kettler, and the signee’s use of Denver Tool Library's lending tools and facilities. 

I state that I am capable and  experienced in using the tools I am borrowing, and that I will use the tools I am borrowing in a  proper manner. 

I do hereby for myself, on behalf of  my successors and assigns, in consideration of being permitted to borrow tools, waive any and  all claims against Denver Tool Library, its officers, agents, and employees for any injury or  injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from  the Denver Tool Library. 

I hereby for myself, on behalf of my  successors and assigns, in consideration of being permitted to borrow tools, agree to release  and indemnify and hold harmless the Denver Tool Library, its officers, agents, and employees  from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which  arises or may arise or be occasioned in any way from the use of tools I am borrowing from the  Denver Tool Library. I am aware that the Denver Tool Library, its partners, directors, officers,  members, and employees claim no expertise and make no representation concerning the  fitness of any tool for any particular use. 

I affirm that the above information is current, true and correct and may be subject to verification.  I further state that I have read and fully understand the rules and regulations of the Denver Tool  Library and I understand that failure to comply with any of these rules may result in revocation of  my borrowing privileges and/or legal action against me. I have read and signed a Waiver of  Indemnification form, relinquishing any and all claims against the Denver Tool Library, its  officers, agents, and employees. 

DENVER TOOL LIBRARY LENDING - MEMBER AGREEMENT

Here are the rules of our Tool Library Lending program. All members must review and accept the terms below. There will be a copy of this agreement online that you can reference whenever needed. 

Membership Requirements

Valid ID & Card: You must have a valid ID and credit card to keep on file.

Over 18: You must be over 18 years of age to be a Tool Library Member.

Checking Tools Out

Who Can Checkout: Only the person or people authorized on your account can checkout tools. Anyone can return. 

Holds & Reservations: If a tool is unavailable, we can put you on our holds list and give you a call when it becomes available. We cannot, however, reserve a tool for you. All tools are on a first-come first-served basis.

Bits, Blades, & Abrasives: These items may come with your tools, however we cannot guarantee they will. We have some available for purchase, or you can purchase elsewhere. 

During Your Lending Period

Renewals: You are able to renew most of your tools one time for one extra week, however, there are no renewals for high-demand tools.

Tool Problems: If there is evident damage to your tool, if it’s missing a part, or if it doesn’t feel right while it’s in operation, please don’t use it. Bring it back and we’ll replace it.

Checking Tools In

Clean Your Tools: When returning your tools, please make sure they are clean and tidy. Remove debris from your lawn tools, empty your shop-vac/saw dust bag, and wrap your cords. 

Late Tools: Late fees are accrued per tool and a per calendar day basis and are: Hand tools $.50/day, Power tools $1/day, High-demand tools $3/day. If a tool is 60 days late, you will be given 1 week to return/replace tools or membership is revoked. You will be responsible for the full replacement cost if a tool is severely delinquent and/or severely misused. You understand that the Denver Tool Library reserves the right to use appropriate steps to retrieve delinquent tools or unpaid fees including charging my credit card, the use of a collection agency, and/or legal action.
